Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Darb last-mile routing platform (the “Service”). By creating an account or using the Service, you agree to these Terms on behalf of your company.
Service description
Darb provides route optimization and a WhatsApp/SMS location-collection workflow that helps delivery companies plan and dispatch last-mile routes. Features, quotas, and plans may change as the Service evolves. Third-party components (messaging, mapping, and payment providers) are subject to their own terms.
Accounts and tenant responsibilities
- You are responsible for the accuracy of the account information you provide.
- You are responsible for safeguarding credentials and for all activity that occurs under your account and the accounts you invite.
- You are responsible for obtaining any consent required before contacting end customers and for using collected locations only to fulfil the intended deliveries.
- You must comply with WhatsApp and SMS messaging policies applicable in your market.
Acceptable use
You agree not to misuse the Service. In particular, you will not use it to send unlawful, deceptive, or unsolicited messages; to harass or endanger any person; to infringe others’ rights; to attempt to breach security, probe, or disrupt the Service; or to exceed or circumvent plan quotas and rate limits.
Fees and plans
Paid plans, trials, and quotas are described at sign-up and in your account. Details of billing and invoicing are provided when subscription billing becomes available; where a free trial is offered, usage caps apply.
Liability
The Service is provided on an “as is” and “as available” basis without warranties of any kind. To the maximum extent permitted by law, Darb is not liable for indirect, incidental, or consequential damages, or for loss of profits, data, or goodwill arising from your use of the Service. Optimized routes and estimates are advisory; you remain responsible for your delivery operations.
Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or where required to protect the Service or other users.
Governing law
These Terms are governed by the laws of the Sultanate of Oman, and the courts of Muscat have exclusive jurisdiction over any dispute arising from them or from your use of the Service. If you have signed a separate service agreement with us that names a different governing law or forum, that agreement prevails over this section for the matters it covers.
